Tom Sawyer Fitness (“TSF” or “We”) recognize the importance of your privacy and the sensitivity of your personal information. This policy outlines how we handle your personal information and sets out the steps we take to protect your privacy. This policy statement also provides information about the personal information that TSF collects, and the ways in which TSF uses, discloses and protects that personal information in Canada.

How we get the personal information and why we have it
Most of the personal information we process is provided to us directly by you for one of the following reasons:
Membership information collected when joining (name, email, phone number; initial onboarding questionnaire (health and fitness goals); fitness assessments (weight, % body fat, body tape measures).
We use the information that you have given us in order to:

track progress of members in the program;

generate progress reports for members;

evaluate and update personal programs for continued progress and engagement.
Under the Personal Information Protection and Electronic Documents Act (PIPEDA) of Canada, the lawful bases we rely on for processing this information are:
(a) Your consent. You are able to remove your consent at any time. You can do this by contacting TSF at info@tomsawyerfitness.com
(b) We have a contractual obligation.
(c) We have a legal obligation.
(d) We have a vital interest.
(e) We need it to perform a public task.
(f) We have a legitimate interest.

How we store your personal information
Your information is securely stored online on our Customer Relationship Management software (CRM) and offline on our Fitness Assessment Software.

We keep digital personal contact, and personal fitness data for 12 months.

If the client is no longer enrolled in the program, we will then dispose your information by deleting it from our offline data base and online server.
Your data protection rights
Under PIPEDA, you have rights including:

You have the right to ask us for copies of your personal information.
Your right to rectification
You have the right to ask us to rectify personal information you think is inaccurate. You also have the right to ask us to complete information you think is incomplete.

You have the right to ask us to erase your personal information in certain circumstances.

You have the right to ask us to restrict the processing of your personal information in certain circumstances.
Your right to object to processing
You have the right to object to the processing of your personal information in certain circumstances.

You have the right to ask that we transfer the personal information you gave us to another organization, or to you, in certain circumstances.
